Court Rules in Favor of Kroger: “Farm Fresh” Egg Labels Not Misleading

Leading U.S. Retail company Kroger has won a lawsuit disputing the origins of their farm fresh eggs. 

Fresh is Best

Organic whole foods and farm fresh are just some of the titles American consumers see in their supermarkets as they shop for groceries. Can labels be misleading? This is the case of the Sorkin VS Kroger trial. 

Alleged False Advertising?

The case brought to court by the plaintiff Adam Sorkin was a concern that Kroger didn’t sell its “claimed” “farm fresh eggs.” Sorkin argued that the advertising and labels of the Kroger farm eggs were “deceiving to the consumer. 

Misleading Advertising?

Sorkin had also said in his complaint that he had paid premium prices for the eggs bought from the Kroger company and felt that he was misled. 

Paid a “Premium Price”

Sorkin claimed that if he had known the true origins of the eggs, he wouldn’t have purchased them, let alone pay a “premium price” for the eggs.

According to the plaintiff, he purchased Roundy’s eggs at a Mariano Fresh Market store, which Kroger owns. 

A Report Calling for Customer Transparency

Sorkin filed his lawsuit in a timely manner as soon as the non-profit Data for Progress released their report on “consumer transparency,” – according to Reuters.

Caged Chicken Eggs

The report alleged that 53% of Koger shoppers want to know if the eggs are from “caged chickens,” with 12% saying, “No the grocer must not post that information.” Furthermore, 35% said they “didn’t care.”

The Court Ruled It Unreasonable

When reviewing the case, Judge Charles Kokoras said that “farm fresh” didn’t automatically suggest that chickens roamed in grasslands free and ate grain. However, farm fresh refers to the eggs that come from a farm and are bred on a farm.

Judge Kokoras also stated the differences between “farm fresh,” “cage-free,” and “free-range.”

According to Judge Kokoras, assuming that every customer would expect “farm-fresh” to mean free-range or grain-fed birds is unreasonable.

According to Kroger, the company has grown to over 2,600 retail food stores, runs almost 40 food manufacturing facilities, and operates more than 2,000 drug stores.   

It’s About Customers

The company has said that they run under “different banner names,” like department stores, price-impact warehouse stores, and digital stores for customers’ shopping convenience anytime and from anywhere.
